Tds dedeuction on technical services

Hi,

I am a Sole Properitor of a small firm in delhi. This year i filled an ITR of zero as my income is currently below limit. Neither am i liable to service tax. Now coming to the question one of my client is asking me, PAN card details as they say they need to cut TDS on my payment of Rs.15000. This is the second biling of Rs.15,000. Am i liable to TDS deduction, if yes how will i get refunded for the amount that will be deducted. Why is the TDS deducted. Where would i have to go to collect the money.

Do i have to ask for a TDS certificate. What if the client refuse to provide the certificate.

yes they are liable to deduct your TDS as your yearly payment is Rs 30000 from this perticular client of yours. Yes you can claim the refund of TDS deducted while filing your ITR. no need to collect the money, the amount will directly get credited in your ban account. You should demand form 16A from your client who is deducting your TDS. even if client refuse to provide the certificate you can check in for 26AS wether he has deposited the deducted TDS amount against your PAN card by loging in income tax efiling site

 You have not mentioned nature of service but in question you made it clear Technical or Professional Tds applicable 10% u/s 94J  fees for professional or technical services for royalty or sum referred to in sec 28(va) for any remuneration or commission to a directors of company Rs.30000 & Above P.A.

TDS can be viewed in 26AS  & Refund or cliam can be adjusted with your Taxable income.
