Dear Muthu,
TDS credit is claimed by filing return of Income and Sec 115A is no different.......It has given an option of not filing return but it has not prohibited the return filing.........so where circumstances requires like cases of refunds etc return can be filed and refund can be claimed............

Hi,
Our tenant is paying Rs. 30,000 per month as rent for a commercial shop. He is deducting TDS every month but not remitted the same to the Central Govt. for the F.Y 08-09. He has not given us 16A certificate either, even after several requests. Meanwhile we filed our tax return and claimed the TDS credit. My question is, do we get the credit if he has not paid the Govt. or paid the amount late? We have bank statement to prove that the TDS was deducted from rent.

No, you will not get the TDS Credit. For this you have to bring this thing in notice to your assessing officer.

You wont get the credit w/o the TDS certificate. You have to make an application to AO to make that person deposit the TDS deducted and issue the TDs certificate.
