Tds applicable on foreign contractors

Hello,

 

I am a French contactor in the field of tourism working from France for an Indian tourism agency based in Delhi. I would like to know if the commissions I charge to this Indian agency from the business I generate in France is taxable through TDS and if so at what rate.

Thank you in advance for your answer. And please provide the articles of law in support of your assertions. I would be feel very much obliged.

As per my knowledge, the Commission received by you is accruing, arising and is taxable in France. So there is no need to deduct TDS on Commission paid to you by the Indian Tourism Agency.

If your Income would have been taxable in India, then the Indian Tourism Agency would be under an obligation to deduct TDS on the Commission paid to you under section 195 of the Income Tax Act, 1961.
