My client (a company) has paid referral bonus to a foreign company for referring an employee. Is TDS applicable for this transaction?

the authority for advance ruling has held that referral fees paid to overseas client will not be subject to taxes in India.

not so easy to conclude. need to see the Treaty and section 9. This is a litigative issue as services by foreign company are utilised for indian business
