Dear Experts, I would like to now whether trade union is eligable for deduction of Tds . because from one of source i came to know one thing that tds should not deduct by trade union unless and until they do not come under tax audit. this provision for the f.Y. 2016-17 & 2017.18. Kindly give me clear idea to deduct tds or not .

Dear Mugdha,
As per Sec 194, Only those person to whom tax audit under sec 44AB is applicable in the previous FY are required to deduct TDS.
However, under sec 192 TDS has to be deducted in case of payment of salary to an employee. If such TDS is not deducted in such amount then the expenditure of salary will be disallowed upto 30% under sec 40(a)(1.a)
