TDS should not be applicable on foreign agents commission (PAID FROM INDIA )normally if the foreign agent doesn't have any PE in India.

Dear Madam, sir
I am writing you regarding commissions to be paid by an Indian Tourism agency based in Delhi to a French contractor residing in France (myself). Are the commissions of the French agent liable to TDS and if so at what rate?
