You will have to approach AO for certificate for lower deduction or nil deduction u/s 197. Otherwise you have to claim refund through returns.

TDS becomes applicable u/s 194H when the amount of rent increases Rs.1,20,000 per annum.In your case the amount exceeds the basic exemption hence TDS is applicable.If the assessee's income is below taxable limit you will be able to claim the refund of TDS when you file the I.T.Return or approach the AO to grant certificate of no TDS.
