As an individual, I am supposed to pay tax on salary (accrual or receipt whichever is earlier) while my employer is supposed to deduct TDS on payment basis. Now, for salary due in March 2009 but paid in April 2009 my employer has deducted TDS for FY 2009-10 but I need to pay tax in FY 2008-09. Can I take credit of TDS deducted by employer in 2009-10......

Or should I pay tax in FY 2008-09 and claim refund 2009-10

just go as per Form 16, if employer has considered the salary in form 16, he might have deducted TDS on that too. If he has not shown the salary, you need not to show in your ITR

 NO MATTER YOUR FORM 16 WILL ALWAYS SHOW SALARY FOR 12 MONTHS.SO GO AS PER THAT.AND IF M NOT WRONG YOUR EMPLOYER IS ALTHOUGH PAYING YOU IN APRIL BUT DEDUCTING TAX FOR YEAR 2008-09 ONLY WHILE DEPOSTING THE SAME.SO KINDLY CHECK IT WITH THE CONCERNED CHALLAN AND GO ON
