my client pay technical fees to NRI ( Swiss Resident). The swiss dont have a pan. Whether we have deduct 20%. IT is mandatory to get Pan for NRI as per Income Tax Act. IF we deduct 20% then the TDS can be claim by the client. As per DTAA is 10.3%.

Dear Karthik,
TDS is to be deducted at the rate of 20% even though as per DTAA the rate is 10.00% and the same can be claimed by that NRI person by submitting Form 16A.
