The company has certificate for lower deduction of TDS for the period 1st April 2010 to 31st March 2011. The company is receiving payment for the month of Januray to March 2011 in the monthh of August 2011 i.e. after the period of certificate.

 

The question is that as payment is realted to the period for which company has certificate for lower deduction but is receiving payment after expiry of the certificate, then whether TDS will be deducted at lower rate or not? Please refer me the provision s of income tax also.

Sir,

 TDS is to be deducted on payment or accrual whichever is earlier (subject to exceptions like salary etc). So the company will normally be liable to TDS on accrual (i.e. in March). Hence the certificate for deduction of tax at a lower rate will be valid irrespective of the payment being received in August.
