We are deducting 10% TDS on payment of rent to Salma Sultan(Landlady) for ground floor space occupied by us.Again we have deducted 10% for payment to the above landlady against our occupation of 2nd floor flat..The landlady is telling us we cannot deduct 10% on the 2nd floor premises since the rent is Rs.    5000/- pm
 
Please advise.

The threshold limit for TDS u/s 194I is Rs. 180,000/- in the financial year.

Please give the following details:-

1. total rent paid by you for the entire year, (Rent p.m. of both flats * rent p.m.)

2. Tax deducted by you for the rent paid.

3. When TDS remittance was made.


This will help determine whether you have to deduct tax or not.
