Tax when working Overseas and resident of India .

Hi Guys ,

I am working for a MNC in Gurgoan and a resident of India.

I went to Canada on 9th May 2010 and returned back to India on 7th June 2010 and then again i went
back to Canada along with my wife on 9th Sep 2010 and returned back on 27th may 2011.

I was getting my indian salary (as i was an indian employee only) and was getting per diems of 'X' dollars to maintain myself in host location .

I didn't spend my complete per diems and have saved some amount which was converted to INR and deposited to my salary account by my employer .

Would i be taxed for this ?

I have received my form 16 from my employer and i don't see anything related to my per diems in form 16 .

Currently I m taxed on my indian income (Indian salary).

Would you know , how this works etc ?

Any Inputs Please !!

In my opinion, you went on deputation and may not be eligible for " for the purpose of employment" benefit. So you will be considered as resident if you stay in India for more than 60 days. In that case, your worldwide income is taxable.

Would you know how is it taxed ? , would the saved per diem be added to my total taxable income in india and then tax would be deducted or something else .

One more question:

If i would have stayed less than 2 months in India for the finacial year , i wouldnt be taxed for the saved per diems ? is it ?

You shall be required to pay tax on per Diem allowance saved by you.
