Tax relief under section 90 not considered in ITR processing

Hi,

I am on an international assignment and reported my foreign income and tax in ITR. The country I am working in has DTAA with India. I claimed relief under Section 90 for the proportional tax. In my IT processing, the FSI section shows this relief amount but the same is not reflected in line 29 of Tax relief section in the assessment order. I filed for rectification but got the same processing redone with no consideration of this tax relief. This has created a huge tax demand for me.

I have raised a grievance but not sure how much time it is going to take for the AO to act on it. Can anyone provide me with suggestions?

Did you filed form 67 before filing your ITR ?

I have similar demand which is very hefty. I delayed in filing form 67 which is mandatory. I filled and filed for rectification but it got rejected. Any way out please ? There is a heavy interest being levied

Hi , also if this is for FY 2021 -22 , you an file form 67 and file for rectification . The laws were amended recently.so you canfile it till the end of assessment year. Mine happened for last year

@ Pushpraj - Man, I missed that. I remember last year it gave me an error that Form 67 was not filled but for AY21-22 it didnt give this error and I didnt notice that I had to fill that form as well.

@ Atul - Mine is for AY 2021-22. What is the way out now?

AY 21-22 means you have filed last year correct ?

Guys for this now you have to make an appeal. The similar case was held by name of "Ms. Brinda RamaKrishna v. Income-tax Officer" you can check it on google. In this the decision is in favor of assesse and she get her refund.
