Hello

One of my client has paid Income Tax in Country X,and as per the treaty he can claim this tax as relief in India.During the year client has incurred a loss.He is not paying any taxes but getting the loss carried forward.

Now the doubt is if he claims such tax as relief,it will become a refund as he is not paying any taxes.Can he claim such refund in India.

In case of any relief,relief can not exceed tax payable,In case of DTAA assessee can take credit of tax paid in other country from tax payable in India.So if there is no tax payable in India,question of credit does not arise.
