Supreme court upheld calcutta hc decision

The Supreme Court on Tuesday Yesterday ruled that a student entitled to get copy of the answersheet for the purpose re-evaluation.

Upholding the Calcutta High Court’s decision to allow students to see their answer sheets, the Supreme Court allows candidates of all examination to access answer sheets through RTI.

Divya Jyoti, petitioner lawyer said, “The Supreme Court’s judgment would now allow the students to access their answer sheets under RTI Act. The Supreme Court said that examination conducting agencies have no fiduciary capacity and hence they can’t restrict students from seeing their answer sheets. Student can access answer sheets through RTI.”

 

Kolkata University student Pritam Roz had filed a petition in the Calcutta High Court seeking permission to see his answer sheets. The High Court pronounced its judgment in favour of Roz. The University of Calcutta and the Public Service Commission and CBSE approached the Supreme Court against High Court’s decision.
