when we say that in a public company there is requirement of minimum 7 shareholders. whom are we referring to?
Equity Shareholders or Preference shareholders or combined?
The minimum number of shareholders( members?) are the subscribers to the memorandum and it includes both equity and preference shareholders.
As per Section 88 of the Companies Act, 2013 name of all Preference Shareholders will be entered in the Register of Members and as per definition all person whose name is entered in the register of Members will be considered as Member.
