Treatment and penalty of Share Application Money not refunded since 1, 2, 3, 4, 5 and more years.

Refund application money along with interest @ 12% p.a. after the expiry of 60 days, and It shall be treated as a public deposit after the expiry of the said 15 days.

I'll surely do that, but some amount is pending from 2006, should I calculate interest from 2006, or from when companies act, 2013 comes in force.
And is there any penalty for non compliance on this?
