I have dealt with a similar case. In case Service Tax registration is not surrendered, returns are mandatorily required to be filed. Maximum penalty has also been raised to Rs.20000/- per return. But in case of nil return, this penalty could be waived by concerned officer, provided you convince them with reasonable cause. As returns have not been filed from 2005-06 onwards, those that have crossed 5 years have become time barred also. First confirm whether Registration number is still active. In case it is, contact the Range Superintendent and convince him to surrender the registration after waiving off the penalty by giving the facts.
