05 August 2013In case service has not been provided on the refusal of service receiver on the same day on which service was to be provided and service provider has retained certain amt from advance been given , will service tax be charged on the amount been retained?

Based on your plane reading of facts:-
As per Point of taxation rules under service tax, if advance is received then point of taxation will be date of advance received. You need to pay ST on amount received as advance & retained by service provider.
If the contracts cancelled or amount refundable then need to check & study complete facts & circumstances of the case, what about ST liability.
