08 August 2013A partnership firm has carried out extensive repairs to the factory building which are to be capitalised. The labour bills are inclusive of service tax. Can Cenvat Credit be availed?

Yes the credit can be claimed in full treating the repairs as input service ....but the ST paid on the same cannot be capitalised ............

Cenvat credit can be availed as defination of input service includes the services used in repair or modernisation of the factory.
GSTR 9 and 9C for FY 23-24 as amended by Notification 12/2024 dated 10th July 2024(with recording)
