As per final notification/circular is service tax on take away food applicable or not or is it a grey area

Hello Vishal,
Service Tax is charged if AC restaurant facilities are used, however in take away the food is not eaten in the restaurant hence the same shall not be charged to Service Tax

agree with saurabh its correct it is just a sale of goods at hotel and service tax will not apply
