XYZ is properietorship entity (Clearing House Agents), take services of GTA for delivering goods to ABC Pvt. Ltd.
Now ABC is claiming XYZ to show the Service tax deposited and ST returns for Transport services as XYZ is working in the capacity of agent for ABC
The query is whether ABC is correct in such demand,whether the liabilty related to service tax on GTA falls on XYZ

- if service tax is paid on GTA, then u have to produce the bills of GTA with service tax thats enough. if not then ABC is liable to pay the tax as GTA service receipent. |
