Service Tax not charged by Transporter

Dear All,

Please help me out with authentic information , my query is service tax is not charged by Transporter (contrator) in his bill  we have neither paid service tax nor taken the input credit. Please suggest how to proceed now.

In The Case of Transporter, The Service Tax Been paid By Service Receiver Itself in Account of Govt..........

So U Hav to Charges ST on That Bill Issued by Transorter, Paid in Account of Govt............

& Take Service tax Number of Transporter.......

For. eg.

Bill For Rs. 10000/-

Then ST @ 10.3% * 25% = 257.5/-

So Pay 10000 to Transporter & 257.5/- to Govt. On Behalf of Transporter........

This case covered by Goods Transport Agency service in Service tax taxable service list.

If Transporter not charged any service tax in his bill, then service receiver has to pay service tax on taxable amount.

In this case taxable amount will 25% on gross amount charged in bill and service receiver can cenvat credit against his out put tax.

One more problem is there, Transporter didn't mention ST regn no, we have already make payment of few bills after decution of TDS 1% as he falls under individual categaory,
