our company is manufacturing co (pharma), we constructed new production block, fabrication contractor fabrication work is completed at our site, he raised bills with service tax (10.3%). our company is registered service tax (service receivers transport of goods). can we take service tax credit on fabrication work
please help me

Yes, you can take the credit for sure.

You have stated that you are registered as a service recepient of GTA and not stated about registration in r/o central excise. Under Rule 3(4) of the Cenvat Credit Rules 2004, you can utilise the credit only given thereunder cases. If you are a manufacturer also then you can takee the credit on it also and utilise only for providing serbvices or payment of excise duty.

can we pay the service tax on behalf of contractor then can we take credit, is it possible
our purchase dept has passed bills with out service tax,but our contractor is asking service tax amount. Our AGM has told we can pay service tax challan and take credit, is it possible?
