We have a commercial Building and developer formed an Association 1.5 yrs back.
Common Area Maintainance Amt Threshold limit of 10 lacs has been crossed , after formation of association and getting service tax registration.
For last 14 months, Service tax not being charged from owners , though developer was suposed to charge the same.
Are Members legally responsible to pay service as an arrears OR its a Developer who should bear this arrears plus penalty and interest ?
