i have an query where an company is paying for "Auto desk Building design Suite Premium Network License Activation Fees" amounting to Rs. 244800 on which
VAT @ 5.5 % 13484
and on the same amount i.e. 244800 service tax is charged @ 12.36%
Will there be no abatement provision on the same.

Consider this transaction as a manufactured item, how u sell. Only dofference, we need not collect Vat on Excise (Service Tax) portion. Sale of software is also be considered as sale of any other mfg item

Only one tax will be aplicable, VAT or Service tax.

some times the the same receipt is sufferring tax at multiple times(VAT,Service tax and income tax) and in the case of mutual funs agnets it is deduted form their meagre commission.
