My friend is running a manufacturing concern (Propritorship) in the Small scale industrial area. He sells all the goods in the local market only. He is availing some services from GTA and paying service tax for the same. So my question is whether he is eligible to get refund of service tax actually he paid since he has no output service tax for set off.

RCM is not applicable for individuals. Since income of proprietorship concern is assessed as individual income, there is no need to pay ST in regard to GTA services. For ST that is already paid, I think, refund can be applied for explaining the situation.
