08 October 2013I have provided services of value, say, of Rs 30.00 lakhs in April/May 2013 and raised invoice also. But I have not received any payments against the invoices. I opted for Sl.No.B1.3 in ST-3 form i.e. service tax will be paid when payment received. When I completed the ST-3 form it gave error saying ST payable but not paid. Also when xml file generated it also gave error. Kindly comment and advise whether I have opted for correct option instead of paying ST when I received nothing.

Since you have opted the benefit under Rule 6(1) of Service Tax Rules,2004...pls donot show the invoice Amt under Gross Amt ....bcoz since you are liable to pay ST on receipt basis , so as long as you have not received the payments so long the Gross Value of Services will be NIL........so when you receive those amts , then show the same under S no. B2.3 i.e.
