A hospital in Goa was registered under service tax -IE Medical service. Now as per last budget hospital are exempted from medical services.
Registration of service tax is not cancelled- hospital is filing nil return.
Hospitals are using services of others and they are charging service tax in their bill.
Now can Hospital take the credit of those services and can take refund.
Kindly suggest.

No. It cant take refund of service tax paid to service tax providers. If your output service is taxable, you can avail the service tax credit. If your output service is exempted, you are not supposed to avail st credit. It is cost to the hospital.
