Answer - Yes, he has that power, since the provision no where specified the condition of due date...
But appreciate the practical part - had u asked "Will AO call........"
Answer - No, except in exceptional circumstances....
Further acts of AO's are generally guided by the CBDT instructions so that AO's dont misuse their powers.......
