Pls. clear the following.

Newly appointed judges remain under training for one year at Judicial Academy. They will be provided accomodation at Academy without any cost. Please clear, whether this accomodation will be counted as rent free accomodation provided by employer or not. If yes, then whether it will be included in the Salary for the taxation purpose. Can Judges claim any concessions or rebate for that accomodation.

@ Krishna ....

The govt company will be the one which is controlled by state govt or central govt. .

or where more than 50 % the controlling power is held by any govt.

Public sectors are also usually considered synonym of govt company.

And gratuity is exempt for govt sector.

in case of private sector this limit is Rs.10 lakhs

Judges will be considered as govt employee so they need to pay the license fee only  for the accomodation.

There will be no rebate in the license fees. because its a perquisite. And the other rules of perquisites will apply

What about the gratuity amount received by employees of ICAI/ICWAI/ICSI? Because these are autonomous bodies established under respective Acts. Whether the amount received by them is fully exempt of 10lacs limit is applicable?

Autonomous wrks independently bt they  also come in the govt  sector.

As U can see the tag line of ICAI :-

Setup by an act of Parliament

so the gratuity will be exempt under this one category.

HRA is given when Rent is paid. Least of them will be exempt :-

  1. 50 % of the salary for metro cities and 40 % for other cities.
  2. Rent paid in excess of 10 % of the salary.
  3. HRA received

Taxable HRA = HRA received - exempt amount

Salary for this purpose will be = Salary+ DA (if terms of employment provide) + commission ( if given                                                                on              fixed % of turnover)

Suppose if an officer employee has been provided a rent free accommodation by the company, in such case, if such employee has not occupied such rent free house for the whole previous year even after it is allocated to him, then in whose hands the valuation of perquisite will be taxable?

There are 3 methods of calculating HRA

  1.  Annualisation HRA exemption calculation  where HRA is calculated on the yearly basis
  2. Monthly HRA exemption calculation  where HRA is calculated on the monthly basisis
  3. HRA exemption calculation for each period of input change

In the third method suppose salary is 50000 and HRA is 20000 and rent is also 20000 bt for almost 2 months there is loss. In that period salary  is nothing but rent is paid :

So the input change is :

HRA  will be calculted on

when salary was RS 50,000

when salary was nothing even zero or salary changed

when salary was again changed ,..means back to RS.50,000

Normally, monthly HRA calculation is prefferred.

perquisite are fringe benefits. They are provided by employer to employee.

In the above case it wil be taxable in the hands of employee,  bcz House is provided by the employer .

whether he lives in the same house or not , its employee's choice.

bcz the whole year property was vacant, even though he didn't use it. But according to the employer, it was used by him. Otherwise the RFA could be given to someone else.

So ....

taxable in the hands of employee.
