hi..frnds

last yr my father recd salary arrer Rs223500/-(6th pay commission - after deducting TDS) instead of 169860/-(after dedctiong TDs)

nw the excess amount has to be refund i.e. 250000-190000 =60000/-( without deducting TDS

can any 1tell me that how to recover the loss on TDS paying on such excess receveing

plzzzzzzzz its very urgent..

which last year u r talking about 2008-2009 or 2009-2010

ur father can file his return for previou year...by claiming relief u/s 89(1) and ur father can taken the salary given in form 16 and file the return acc & if any refund comes then shall be credited in the a/c

I guess your dad should also show the calculations of marginal relief in form 10E whereby he should claim the marginal relief by taking into account the respective years slabs

yr salry recd on oct 09 and i think relief taken u/s 89(1) is only for the difference in yr by yr slab changes ..so there is no need of releif becz salary is recd in 09-10..

i think i shud deduct the excess money then calculate tax as according A.Y 10-11 nd after that deduct the tax which we already paid as TDS

nd nw it comes refund..............

in case of salary arrear the releif shall be available on received basis i.e releif available in the year in which arrear received........

Dear pooja relief is claimed when arrears of salary is received...even thou the salary is recievd in this oct but it actually relates to some prev years ..tats y there is a rise in his salary income..right?
