Returns be filed before AGM

Our company AGM is on 30/10/2008.But the due date for filing return is 30/09/2008.Can we file the returns before the due date on the basis of the financial statements still to be approved in the coming AGM.Is there any provision in income tax act or some other act.if yes plz mention the relevant section.
