if one of the first subscribers to MOA is non-resident, does embassy or notory attestion is required on MOA and AOA.

See first if he is signing in india all the documents then business is required to be attached(in case of Person is of Indian Origin or Overseas Citizen of India, requirement of business Visa shall not be applicable.) , if he is signing outside india then documents needs to be appostille or notarized as per rule 13(5) of companies incorporation rules 2014
