10 September 2012I receive rent from my building on three categories of tenants:
1. From shops and banks- Rs.11 lakhs
2. From residential families- Rs.5 lakhs
3. From A company whose employees live in the flats(agreemnt with company)- Rs.6 lakhs
I want to know my whether service tax is applicable in the third category i.e., rent received from company for accomodation of its employees.

Service by way of residential dwelling for the purpose of residence is not liable to service tax whether the agreement is with the employer or not.

As the purpose of letting out is for resident and not commercial or industrial, service tax is not applicable.

We are a co engaged in business of manufacturing ready made garments. We pay excise duty at 30% of MRP on the garments sold. Are we eligible to avail cenvat credit of service tax on the rent of factory premises and also on the security srvices paid to a corporate security service provider.
