we R registered Company in West
Bengal. we have some building in Bokaro in Jharkhand. we received Rent from that property. The Tannent is registered in WB and their Branch
office in Jharkhand. we make bill from WB. address to Bokaro and charge IGSt. now the Tannent pressure us make bill with sgst and cgst and address to their WB office. sir it is possible? we make some repairs work in that building like painting.civil etc .now question is should we take ITC. we have only income of rental

Hi Anshuman,

Please note that you may raise the bill at their WB address as well but still this transaction will be an inter-state supply and IGST will be charged.

In case of immovable property, place of supply will be the location of property.  As you are registered in WB, it will be a inter-state supply as location of supplier of service and place of supply is in two different state.

As far  as input on paintaining  and civil work is concerned, please note the ITC is not available on these two supplies - Pls refer section 17(5)

 

it's means that we have not avail to take ITC. our lawyer said we take ITC because we have only rental income and we make repair works in that property
does not make any difference whether you have only rental income or other income as well.
but if this expense is not capital expenditure in nature, you may avail input
