Dear friends, We have filed form ADT-2 for Auditor Removal of a private limited company. In response to the same RD issued a Notice on the company, directing to serve a copy of petition to the auditor. My query is - whether altogether new petition to be drafted and served ? or Form ADt-2 with its attachments is is itself a petition ?

Your communication with the Central Govt/RD via ADT 2 along with a notice from the company regarding its decision shall be served on the auditor.
Please make sure that the general meeting for removal is held within 60 days from receipt of approval and the audior is given an opportunity to be heard.

Form ADT 2 along with its attachment itself is the petition and communication to RD for the removl of Auditor. Make Sure that form ADT 2 is made within 30 days of the resolution passed by the Board along with the application in form of petition.Also Hold the general meeting within 60 days of approval from RD and before all such documentation make sure that auditor has been given the reasonable oppertunity of being heard.
