Registeration for 100% EOU

A newly incorporated company intends to provide services to foriegn companies and the services would be exempt under the Export of Service Rules. Now the query is wheather the company required to obtain the service tax registeration number. If yes than the company would be required to file NIl returns.

Please suggest.

You may not have any output tax, however you can claim refund of service tax paid against various services.

100% EOU is not declared by assesee or service provider but a seperate authority is there to grant 100% eou status to unit.

in absence of above the unit is normal local unit, and would be eligible to file refund claim under export of services rules.

I understand that the refund can be obtained if the services the utilised for exports. My query is if the service provider does not intend to claim any refund. In such case, is he liable to get himself registered with service tax department or he may provide services without obtaining service tax registeration. Please suggest.
