Regarding Transfer

Hello,

I have completed 6 months of articleship. Now i decided to take transfer from the current firm. Please tell me the procedure to take transfer.

My principal told me to give 1 month notice that i m going to transfer to so and so firm and allowed to take transfer on next month. Is it necessary to give notice to him??

Please reply urgently.

It is not necessary to give notice but without notice ur relation with CA may unfavourble. . . .

it is not necessary but for safer side give notice is better

well as per the new ICAI rules, transfer just cannot happen. It is mentioned in the latest issue of the student accountant. The new rule states that you have to first confirm with the regional council before taking the transfer. only when they ( regional council) agree, can you proceed to send them the form signed by the principal.

else, It would be a long long tym for the transfer to get approved. 

I have heard that according to new rules i can take transfer within 1 year without taking permission from regional counsil. Is it not true?

YES YOU WILL HAVE TO SEND SIMPLE APPLICATION TO INSTITUTE BEFORE FILING 109

Can anyone tell me clear procedure to apply and get transfer from my employer. I have completed my 10 months of articles and want to change.
Write a application on plain paper to regional office with appropriate reason of transefer and when they give u permission, send form 109 signed by employer within one month. . . . . . .

Hello Sir,
I am Amitoj Singh Arora, PCC Student.
my training has started from 10.09.2008 and due to some problem with my CA, i left my office on 14.07.2010 with form 109 signed form him. But as i came to know about the condition of prior approval for termination, my Form 109. sent to institute become invalid and i havent received any letter from institute regarding that. And till now due to certain problems i am unable to send any letter for permission of termination of articleship to institute.i m unable to find a valid n justifiable ground under sec 56(1) under which i can seek permission neither i can join back my current CA due to certain reasons.

1) I js want to know what will be the circumstances if i seek prior approval from institute for termination with effect form 14-07-2010. Will institute take any action on noticing the my absence from Office for approx last one year.....?

2) what remedies i have now to get termination ? just worried about that one year gap?
