In compensation of a case in Labour Court, I got Rs.250000/- from my prev. Employer in FY 2008-2009. They deducted TDS Rs.10300/- & given me Form 16 mentioning the Payout Rs.250000/- & TDS 10300/-.
This Compensation is not the Income of 2008-09 but it has been paid after the decision of Labour Court as a compensation of 2002 to 2008.
Kindly suggest me whether I can get the TDS refund or Not.

Dear Nitesh,
The above compensation will be taxable as Salary in FY 2008-09
Employer has also deducted TDS based on Slab..
U file ur Income Tax return including above compensation & if refund is due then yes u will be allowed....

Compensation - Taxable as Salary in FY 2008-09..Form 16 issued by employer...
plz file your IT return including the above and refund if any can be claimed....
