My Client has Paid late Fees which was application before for the month of Nov 17, Dec 17, Jan 18 and now as per latest notification the late fees has been waived off. The Client want to claim refund of the late fees paid for above months. There is not amount shown in Electronic credit ledger.
My Question is : Can we Claim the late Fees amount as refund??
Kindly provide me your valuable suggestions.

The notification doesnot provide the provision for refund of late fee paid. Clarity on this aspect is awaited from the Government.

Dear as per notification for filling return after 22/12/2018 not earlier it is waive of late fee for pending returns not filed earlier

Yes you can claim the paid late fee as refund as it is your right ?
No statutary body has power to infrig the constitutional as well as principals of natural justice as this notification clearly implies the baisness as well as hardship of the law?
You can file a writ petition challlenging the vires of this notification
