can late fee be claimed back after filling of return as government has waived such fees?

No, because GST council has recommended late fees waiver for pending return for the period July-2017 to Sep-2018 filed after 22.12.2018 but on/before 31.03.2019. So, this doesn’t cover returns which are already filed with late fees.
“Late fee shall be completely waived for all taxpayers in case FORM GSTR-1, FORM GSTR-3B & FORM GSTR-4 for the months / quarters July, 2017 to September, 2018, are furnished after 22.12.2018 but on or before 31.03.2019.”

However, biggest question remains whether fee will refunded to those who have already paid late filing fee. I don't think GST department will refund or credit the fee paid back to tax payers.

I filled GST-4 from Oct 2017 to Sep 2018 on 23-12-2018 with late fee as system was showing automatically while creating challan.

Oh today the portal is not showing any late...
till now there is clarification on refund pls wait for notification from govt.. Surely they will refund for everyone.

You can't claim refund but you can offset with Late fee payable (for further late filing months).

anyone aware on status of this topic?
Waiver is for those people who paid later after government declared waiver.
But what about those, who already paid before 22nd December 2018
I think, govt cannot do such partiality.
