My client has exported the goods without payment of IGST during the whole F.Y 2023-24 but have applied for LUT in December 2023.
now if i apply for refund officer may ask this query.
Q. How can i get refund of ITC for export transactions made in non LUT period (April to November 2023).

Prepare Statement 3:
Statement 3 is prepared as per rule 89(2)(b) and 89(2)© of the CGST Rules, 2017.
Key details to include in Statement 3:
GSTIN Number
Return Period (from and to)
Type of Document/Invoice No./Date of Invoice and Total Value of Invoices (ensure consistency with filed GSTR-1)
Refund application filed for Export of Goods or Services
Shipping Bill/Bill of Export/Endorsement invoices (for export of goods)
EGM (Export General Manifest) details (EGM Number and EGM date) – verify against ICEGATE IGST Validation details1.
Calculate Net ITC:
The refund formula considers “Net ITC” for the relevant period when applying for GST refund.
Unfortunately, claiming ITC for an earlier period (before LUT) is not possible due to the system limitations1.
File the Refund Application:
Access the GST portal (URL: GST Portal).
Navigate to Services > Refunds > Application for Refund.
Select the refund type (refund of ITC paid under export of goods/services without payment of IGST).
Fill up the necessary details and submit the application2.
