Refund of GST

A registered person had paid tax and penalty on detention of vehicle by proper officer due to some reason ..

Hence in electronic cash ledger CGST,SGST, PENALTY amount is there from December 17 on wards...
it is not adjusted due to conditions specified in electronic cash ledger...

How to claim refund of above amounts?

If penalty levied by proper Officer then the Penalty is Your liability...
No way for adjust in any other heads...

You have to declare your liability on the same and set off against it

Penalty is not set off anyway... Bcoz, it's penalty. In case any options provide by the officer then it is adjusting to the penalty which is given by the Officer...
