can i claim arefunf if the return was filed belated if yes under which section if no why???????????

yes
if you have deposited exess tax and filed a belated return...than type of return will not affact your refund....go and ask your assessing officer for your refund....
usually refund take5-6 momnths from date of filing
regards.
