rebate u/s 88e

one of my client  earns speculation income from shares i.e. intraday( considered as business income-PGBP), STCG and LTCG. H e has other business income too. Supppose the tax payable at normal rate comes to Rs.1000/- and the tax payable at special rate on STCG comes to Rs.40000/- (Total tax payable -41000/-). The STT paid is considered for rebate also considering the average rate of tax. Now, the rebate comes to Rs.8000/-. Will this rebate be adjusted only against the normal tax of Rs.1000/- or will it be adjusted against the whole tax of Rs.41000/-. I have one of the well known software for tax calculation which restricts the rebate only to Rs.1000/-. However , going through the IT Act, there is no such clause u/s 88e that the rebate can be adjusted only against normal rate of TAX.

 

Please solve my question. Specify any relevant case laws if any.
