Whether RCM applicable for Exhibition expenses outside India

As per Section 2(11) of IGST Act ‘2017, ‘‘import of services” means the supply of any service, where:

(i) the Supplier of service is located outside India;

(ii) the Recipient of service is located in India; and

(iii) the Place of Supply of service is in India;

As per section 13(5) of IGST Act : The supplier & services held outside India , No GST is applicable

in case of import of service without consideration from outside for business purpose then RCM is applicable

with consider must

In term of para 4, of schedule I, Import of services is Taxable when there is no consideration.

Actually it means "without consideration " is import from Related person or from other establishments outside India in course & furtherance of Business.

Hence RCM is applicable.
