Hey When sale with out Form 'C'' the applicable rate is 1. Actual rate in the State to the Commodity. 2. Highest rate though the commodity not found in the rate card. you not mentioned you state so cant able to give exact solution.

If you are making a interestate sale without form C than applicalbe rate will be "rate applicalbe if the same goods is sold with in the state".
In your case since you have bought goods at 5% which is rate applicable for sale within state same rate is applicable when you sell it out side the state with out form C.

If the rate in the state is 5% the rate outside the state with out C form is 5%
Means you cant charge the Tax more than the rate which you are charged in the state.

Yes in case of Non Form C transations you can not charge rate more than the charged for the same transaction with in the state.
