If a person getting HRA from his employer and he also paying rent to owner but for some reason he couldnot submitt document to his employer for HRA exemption so his employer not shown the same in his Form no. 16. so my question is whether he is eligible to get the same exemption or need to rectify Form no. 16.

While filing the return you can cliam that exemption..

Of course yes.there have been instances where Sec 80c deductions are not reflected in form 16,and we do allow them while filing returns earlier.
But,now since form 16 is construed as the IT Return till the income exceeds 5 Lacs,it is advisable to amend form 16 so that the employer could send it to the department.

ask employer to rectify form 16 , or go as per form 16

ask him to rectify form 16 or you can show in your working as well in ITR
