1. Trademark Search

Before applying, the crucial step is to conduct a trademark search to ensure that your desired trademark is not already registered or pending with a similar name/logo. This search can be done through the official website: https://ipindiaonline.gov.in/tmrpublicsearch 

2. Pick the Right Trademark Class

Trademarks are categorised into 45 classes based on the type of goods or services. Choose the appropriate class(es) based on your business activities.  

3. Filing the Application

You can file the application online using the official portal: https://ipindia.gov.in or offline at the appropriate Trademark Registry Office. This application demands certain requisites that are listed below:

  • Applicant details

  • Trademark/logo 

  • Class of goods/services

  • Power of Attorney (if filed through an agent)

  • Government fees

4. Examination of submitted Application 

The Registrar examines the application meticulously to ensure it complies with the Trademark Act. You may receive objections (if any), which you’ll need to respond to within the specified timeframe.

5. Publication in Trademark Journal

Upon approval of your application, your requested trademark is published in the Trademark Journal for public opposition. If no opposition arises within 4 months of publication, or if opposition is resolved in your favor, it proceeds to registration.

6. Registration Certificate

If all goes well in your favor, you’ll obtain a Registration Certificate, and your trademark will be protected for a period of 10 years and can be renewed afterwards.
